Law Coursewor - Williams v Roffey Bros Ltd (Contractors) - Case Report?
I am currently studying law at HNC level and have to write an essay examine the case of Williams v Roffey and Consideration as a whole in construction contracts.
I believe I have all the documentation I need to study the case, however, reading the case (and being my first time at reading cases such as this) I am having difficulty understanding one of the outcomes.
I can see that Williams won his case and was awarded payment, but then the defendant (Roffey) appealed. I may be being slightly foolhardy, but did this appeal against the previous judgement succeed?
Help is greatly appreciated...
i remember doing the case for contract law during my first year of law. The thing i learned during law school is that it's best to read about a case from secondary sources first (like text books) before going on to the case report itself. That way, you know which judgments are actually dissenting, and which are agreeing without getting too confused. So i recommend you read the relevant areas in the text book. Then maybe try reading the case in a case book. The important extracts from the report will be given so all the irrelevant stuff in the case will not muddle you up.
I'm sorry i can't remember the case myself anymore...but if the case was appealed, there should be a reference to that appeal case report in the report you're working with(i worked with online reports, so these usually had this facility) and so you can go on to read that higher court judgment to find out what happened.
In all likelihood, that decison probably doesn't matter... If it had overrulled the judgment you are currenlty reading, you would have been asked to read that higher court judgment instead! (NB, i presume you are reading the 1991 CA report)
